Welcome to House of Amila ("we", "us", or "our"). These Terms of Service ("Terms") govern your access to and use of our website houseofamila.com (the "Site") and your purchase of products from us.
By accessing the Site, placing an order, or using our services, you agree to be bound by these Terms. If you do not agree, please do not use the Site or place orders.
We are a South Africa-based online store specialising in premium gallery-wrapped canvas prints celebrating African-inspired imagery. All sales are made directly between you (the customer) and House of Amila. Shopify Inc. or its affiliates provide the platform but are not a party to any sales contract.
1. Use of the Site
You must be at least 18 years old or of legal majority age in your jurisdiction to use the Site or make purchases. You agree to provide accurate, current, and complete information during checkout or account creation. You are responsible for maintaining the confidentiality of your account and for all activities under it.
We reserve the right to refuse service, terminate accounts, or cancel orders at our discretion (e.g., for suspected fraud, policy violations, or unavailability).
2. Products and Orders
- All products are made-to-order and produced only after your order is placed and payment cleared.
- Product images are representations; slight colour variations may occur due to screen settings, printing processes, or materials.
- We endeavour to describe products accurately, including sizes, materials (artist-grade canvas, UV-resistant inks, gallery-wrapped on 3.8 cm stretcher bars), and care instructions.
- Prices are in South African Rand (ZAR) and include VAT where applicable. We reserve the right to correct pricing errors.
- Orders are offers to purchase; we accept by confirming shipment or sending an order confirmation email.
3. Payment
Payments are processed securely via Shopify Checkout and our integrated gateways (e.g., credit/debit cards, EFT, PayFast, PayPal where available). Full payment is required at checkout. We do not store full card details. You authorise us (or Shopify) to charge the selected payment method.
4. Shipping and Delivery
- South Africa: Free standard tracked shipping nationwide. Delivery: 4–7 business days via trusted couriers (e.g., The Courier Guy). Can be longer depending on area and unknown production issues.
- Delivery addresses must be accurate; we are not responsible for failed deliveries due to incorrect details.
5. Returns, Refunds, and Cancellations
In line with the Consumer Protection Act (CPA):
- Cooling-off period: You have 5 business days after receiving goods to cancel for any reason (CPA Section 16), provided goods are unused, in original condition, and packaging intact. Return shipping costs are your responsibility unless faulty.
- Faulty/damaged/incorrect items: Report within 48 hours of receipt with photos. We will arrange collection (at our cost) and provide repair, replacement, or refund (including return shipping).
- Custom/made-to-order products: Generally non-returnable/non-refundable except for manufacturing defects or damage in transit (as these are personalised per your order).
- Refunds processed to original payment method within 10–14 business days after we receive and inspect returned goods. No cash refunds; credit or replacement may apply in some cases.

6. Intellectual Property
All artwork designs, images, text, and content on the Site are owned by House of Amila or licensed to us and protected by copyright and other laws. Purchasing a print grants you a limited, non-exclusive licence for personal display only—not for reproduction, resale, commercial use, or derivative works.
7. Limitation of Liability and Disclaimers
To the fullest extent permitted by law (including CPA):
- Products are sold "as is" with no warranties beyond those implied by law or stated in product descriptions.
- We are not liable for indirect, consequential, incidental, or punitive damages (e.g., lost profits, data loss).
- Our total liability shall not exceed the purchase price of the product in question.
- We disclaim liability for delays, interruptions, viruses, or third-party actions (e.g., carriers, payment processors).
8. Indemnification
You agree to indemnify and hold us harmless from claims arising from your breach of these Terms, misuse of the Site/products, or violation of third-party rights.
9. Governing Law and Dispute Resolution
These Terms are governed by the laws of the Republic of South Africa. Any disputes shall be resolved in the competent courts of Gauteng, Johannesburg.
10. Changes to Terms
We may update these Terms at any time. Changes will be posted here with a new "Last updated" date. Continued use of the Site constitutes acceptance.
